Civilian staff is those who employ in military in accordance with the relevant provisions of civil establishment, and perform the obligation of officers in active service who are in the same position. They belong to non-active civilian staff. The system of employing civilian staff refers to stipulating the rights, obligation and responsibility of both parties clearly in accordance with equal principles of both parties by way of contract. It is so important for developing the national defense education. The implementation of employing civilian staff system is a major measure of the reform of our armed force constitution and personnel managing system. Employing Civilian staff in military academy is to build personnel managing system which is separation of identity and post, the flexible and efficient. It is of great significance to establish the civilian staff system. On one hand, the civilian staff system is the need of development of the army. On the other hand, the implementation of employing civilian staff system is an effective way to strengthen the construction of the military instructors. Moreover, it is of great significance to optimize the organizational structure of our army and make the rational use of social intelligence resources. With the implementation of the civilian staff system, the civilian staffs that are from the local to the military academy pay closer attention to safeguard theirs’lawful rights and interests. However, various problems caused by rights and interests will gradually emerge with more and more civilian staffs into military academy, especially officers in active service demobilized into civilian staffs.How to safeguard rights and interests of the civilian staffs in military academy has become an important problem and urgent to solve by the organ of PLA General Departments and institution of the army. Civilian staffs in military academy should not only enhance the consciousness of rights and obligations, but also strengthen their own qualities by learning the knowledge of laws and regulations on the basis of getting to know the principles of management, so that enhance the capability to self-protect the legitimate rights and interests. Military academies will intensify the protection of the legitimate rights and interests of civilian staffs by the following four aspects:1. Constitute rights and interests protection mechanism of civilian staffs in military academy2. Constitute the development mechanism of civilian staffs in military academy3. Constitute the work evaluation mechanism of civilian staffs in military academy4. Constitute the right protection mechanism of civilian staffs in military academyThe army should establish the sound and effective rules and regulations of civilian staffs, meanwhile should implement matched social security mechanism to protect the legitimate rights and interests of civilian staffs. In conclusion, if the three aspects cooperate effectively, the legitimate rights and interests of civilian staffs can be protected multilayered and multiaspectedly.
