At present our country is at a social transforming period when its society was changing from a traditional society to a modem one, the survival and development of the Chinese nation faces unprecedented challenges and opportunities. On one hand, the national economy gets sustained, rapid growth and the China’s comprehensive national strength has been significantly improved, the living standard of the people has been greatly improved. On the other hand, because of the rapid economic development, the ecological issues such as environmental deterioration, resource depletion are also growing, and already endangered the quality of life.The report to the Party17reported that:"constructs the ecological civilization, forms saving energy resources and protect the industrial structures of the ecological environment, the systems of the growth and the patterns of consumption. The circular economy forms a large scale and the renewable energy shares increased significantly.The main pollutant emissions are effectively controlled, the quality of ecological environment gets significantly improved. The concept of ecological civilization in the entire society is firmly established." It provides a theoretical and methodological guidance for us to solve the ecological problems in the social process of rapid development, the "ecological civilization" will also become the focus of the new period, become the focus of the investigation and research of scholars. In the selection of the mode of the construction of ecological civilization, ecological civilization construction of the rule of law will undoubtedly become the best choice and most important protection. Only given full play to the role of the legal norms, constrain people’s behavior by legal weapons, given a severe blow to the destruction of the ecological civilization of people, sanctions, in order to ensure the smooth people’s socio-economic development and the construction of harmonious society.Firstly, the paper starts from the scientific connotation of ecological civilization and analyzes the concept of the ecological civilization, the basic characteristics and the main contents, proofs the significance of China’s construction of ecological civilization. The ecological civilization is the production of the development of human history in a certain stage, is the advanced forms of the civilization in the history of mankind. Only understanding the basic meaning of the ecological civilization deeply, we can know the importance of the ecological civilization and the urgency of protecting the ecological civilization by legal weapons.Secondly, the intensions of the harmonious society are briefly discussed. The paper pointed out that the harmonious socialist society and the rule of law are inseparable, and then discussed the relationships of the ecological civilization and the harmonious social. The rule of law is the only way to achieve the harmonious socialist society. The harmonious socialist society is a better society that the human being has been pursued. It is a society of harmonious development between people and nature, people, peopie and social which the harmony between man and nature is the basis. The rule of the law is the basis of the protection of the harmonious society. The legal construction of ecological civilization is an inevitable choice for social development.Then, based the exposition of the basic principles, the writer posed the current situation of our needed from three aspects:legislation, judicature, law enforcement. And described the current legal environment in China in four aspects of the legislation, judicature, law enforcement and the law-abiding and pointed out the inadequacies.Finally, on the basis of these shortcomings, the author raised little suggestions to the legal construction of ecological civilization from the improvement of legislation, coordination of law enforcement, the establishment of a specialized judicial organ, raise awareness abiding sense of the establishment of a related system, etc.. Through these, the author hopes to promote the rapid development of ecological civilization and the rule of law building process for the early realization of the ecological civilized society to do their modest.
