Research On The Protection Of Peasant’s Right And Interest In The Exploitation Of Rural Tourism

Since China is an agricultural country, the issue of "Three Agriculture"(Agriculture, Countryside, Peasants) is always most important to the whole Party and it is the priority among priorities of the national work. The peasant problem is the key issue of "Three Agriculture", while the core of peasant problem is peasant’s right. In recent years, the vigorous exploitation of rural tourism has become an important approach to solve the problem of "three agriculture" and develop the new socialist countryside. However, the peasant’s right and interest is frequently violated in the process of exploitation of rural tourism.And these problems have affected the harmony and stability of the society, therefore, we need to solve these problems properly.Firstly, the paper introduces the rural tourism and its exploitation. According to the theory of stakeholder, we can find the relevant rights and interests of the farmers who are one of the stakeholders in the exploitation of rural tourism. And these rights include peasant’s land rights, environmental rights and the other relevant rights and interests. We point out that it is necessary to protect these rights and interests through data analysis.Secondly, based on the actual situation and related data, we conclude the status of the violations of peasant’s right and interest in the development of rural tourism in our country. And further more we analyse the cause of the violations of peasant’land rights, environmental rights and other relevant rights and interests.Thirdly, we discuss the theoretical basis why peasant enjoy those rights and interests and the necessity to protect their rights and interests and how to solve the problem to protect their rights and interests in the exploitation of rural tourism. This leads to the end of the paper.Finally, to sum up, we give suggestions to improve the protection system of peasant’s right and interest in the exploitation of rural tourism in terms of land rights, environmental rights and judicial remedy respectively. And we believe that this paper can contribute to the standardization of exploitation of rural tourism to protect peasant’s right and interest on the level of legal and policies.
