Research On Water Marketization Reform And Law Security System

Water industry is an important part of public utilities, which is related with people’s livelihood and social economic development. Reform of water industry is an ongoing topic of a century, constantly changing to adapt to development of social economic. However, water marketable reform had not began until the age of70th and80th in20th century, from Britain, France, the United States and other developed countries, gradually sweeping the world, and achieved outstanding results. In our country, water industry is accustomed by government and citizens as the cause of welfare something to do with the country and the government departments. In the early days of our country, implementation of planned water allocation under the traditional planned economy system should be affirmed conducive to China’s social and economic development. But with the establishment and deepening of the market economy, the traditional water system is no longer adapted to the development of social economics.At the end of last century, our country was first to start marketable reform in water sector in the investment and finance area. Reforms such as the vertical integration of water separation, separation between government and enterprises, the government-owned separate transformation of government functions, bring much benefits such as increased business efficiency of water industry, financing increased, market vitality, water resources can be better protection and utilization. However, market-oriented reform of water is still implemented with the old laws, regulations and procedures based on the existing administrative system, and we are used to the habit of "first test, after the conclusion, then the legislation" path, which make the reform of China’s water market face great political risk, legal risk and economic risk.In order to solve the problems of water marketable reform in our country such as the general market, irrational pricing, investment and financing legal system is not perfect, imperfect regulatory system, many related reforms should be follow:designs of laws and regulations by distinguish between the different operations, building pricing mechanism adapt to market-oriented reforms, improving the investment and financing of the legal system and regulatory system, establishing a water safety laws and security system, a fundamental solution to the problem of financing the water industry, improving the efficiency of the water industry, promoting water environment governance, promoting to build resource saving and environment-friendly society.
