The arable land is needed for agricultural production of the most basic materials, any one of the country’s stability and orderly development with the scientific use and effective protection is closely related to the arable land. China, as a large agricultural country with a long agricultural tradition and the800million farmers, the state’s food security,hundreds of millions of farmers’ livelihoods are dependent on the quantity and quality of arable land and protect arable land to help rural and social stability is an important part of building a socialist harmonious society. Therefore, the protection of arable land is not only important but urgent.Gone through various changes and development of China’s arable land protection legal system in a different period of development of society, so far, the introduction of relevant laws and regulations as the representative of the People’s Republic of China Land Administration Law and the People’s Republic of China Land Management Ordinanceboth provisions to protect the quantity and quality of arable land from several angles. Nevertheless, China’s arable land to protect the legal system there are still some loopholes in the imperfect system settings to make the law in practice can not be good to adapt to the actual arable land can not be effectively protected.In this paper, the literature on the status of the legal system of China’s farmland protection; the use of case study method and the comparative method, some provinces and cities of advanced protection experience and advanced protection experience of developed countries were studied. In addition to the introduction and conclusion, the article is divided into three parts.The first part of the legislative status quo of China’s arable land protection system and problem analysis. Through the development of legislation on the protection of cultivated land in China’s legal system and system status, the basic content of the present system, which found that the problems in the existing system, and analyzed. The second part draw on the experience of the legal system of domestic and international protection of farmland. Briefly introduced the advanced experience of the protection of farmland from home and abroad. The domestic part of the provinces and cities of Tianjin, Henan and Guangxi Autonomous Region. Abroad for U.S., UK, South Korea and Japan.The third part of the proposed countermeasures to improve the protection of cultivated land in China’s legal system. By the foregoing problems and the advanced experience of research and analysis, combined with China’s national conditions, the future perfect the legal system of China’s farmland protection countermeasures.
