Cultivated Land Protection Legal System Construction

From the1980s to the present, protection of farmland after30years of practice, China has basically established a relatively complete legal system of protection of farmland, and provide a powerful legal guarantee on China’s arable land resources protection. But with the socio-economic continuous development, some weakness on China’s arable land protection legal system were gradually exposed, it has to adopt an urgent need based on the sustainable development, the harmonious development of the new requirements of the new era, amendments the existing legal system, to form a set of technical content with high operability execution farmland protection legal system, and to protect of scarce arable land resources.Through the use of literature and a comprehensive analysis of contrast, combined with the Tianjin farmland protection system practice, from both theoretical and practical to analyze of the current system for protecting farmland, and take reference from foreign advanced farmland protection experiences, some improvement, innovation of China’s farmland protection system policy are recommended.The thesis has been divided into five-part. The first part through the analysis of the current situation of China’s cultivated land, leads to the need for the protection of arable land, as well as the importance of improve farmland protection system. And in turn, introduced the legal system of the United States, Japan and other representative national farmland protection, in order to seek the revelation of the legal system of China’s cultivated land protection; the second part describes the protection of farmland, farmland protection legal system and other related concepts, and analysis of the legal system of China’s farmland protection system and its theoretical basis; the third part, combined with the protection of farmland material, analyze the stage of development about the legal system of China’s farmland protection and introduced the main content of China’s farmland protection legal system, and then analyzes further on the contradictions of the reality of the legal system of China’s farmland protection system and its defects; the fourth part is for the analysis on farmland protection in Tianjin, and the practice of the legal system, designed a sampling survey, investigates and analysis Tianjin Public farmland protection awareness, level of knowledge of the legal system as well as farmland protection willingness to participate condition; last part for the suggestions on innovation, improve the legal system of China’s farmland protection.
