Rural Drinking Water Security Of Legal Research

Water is the basic guarantee of human existence. Safe drinking water is the basic guarantee for our health and life security. In our country, there are a large number of rural populations, it is very important that applying safeguard measures to protect safe drinking water. Safe drinking water is the requirements of sustainable development theory, but also the focus of environmental justice theory. Unfair situation are very obvious between rural and urban, for the long-term social and historical development of inertia. The rural economic drops behind the city, the peasants’cultural quality is low, the rural environment pollution damage is more severe than city, but no effective governance and improving. The scholars pay attention to the safety of drinking water of city and research the safeguard of it. And at the same time, they take security measures, but the rural drinking water safety has not been given widespread concern. At present the rate of our country rural drinking water safety penetration is low, the destruction and pollution of the rural drinking water suffered from the various factors of mankind and nature include the life and production of the rural residents, and the pollution of city transfer to the rural areas. The rural failed to drink that much of the safety and health of the drinking water. This paper attempts to analyze the social factors and legal factors of rural drinking water safety from the point of sustainable development, environmental justice and public goods theory, and I put some advices forward to improve the legal security.This paper is divided into four parts. It involves drinking water safety theoretical basis, the rural drinking water safety situation and cause analysis, foreign advanced system reference and legal perfect.Ⅰ. First of all, I analyze that ensuring rural drinking water safety is the basic of achieving the justice of urban and rural from the point of the jurisprudence and the sustainable development of environment law theory and the theory of environmental justice. It is also the realization of the most important aspects of the urban and rural environmental justice, and analyzes the particularity of public goods by using the theory of it in rural drinking water safety. As public goods, it needs to undertake supply responsibility by the government. Ⅱ. It points out that the present situation and existing problems of the rural drinking water safety. It mainly involves the pollution and destruction of drinking water, and the rural drinking water project is not perfect. And the reasons what results in unsafe is our country in the law did not pay attention to the protection of the rural drinking water safety, less provisions are in many of laws and regulations, or more general and abstract provisions. The maneuverability is not strong, it leads to the insufficient in law enforcement of the drinking water safety, and it can’t protect the rural water safety from the legal, the minimum standards.Ⅲ. This paper introduces the foreign advanced and perfect national drinking water safety law protection system and measures, including the United States, Japan and other countries of the system. The local laws and regulations established the priority place of drinking water protection in some cities of our country, and it also stepped up to the protection. It provides the experience to other provinces and cities on establishing and improving the protecting system of drinking water.Ⅳ. On the basic of analysis and comparative in the form three parts, I make some advices in protection of rural drinking water in our country. It includes that it must firmly carry out the sustainable development concept in the legislation thoughts. It should reflect the fair idea of environmental justice in environmental protection legislation and practice. The drinking water safety protection should be the absolute priority protection status, and I make some suggestions about the weakness in the modification or perform of law in our country. Making sure that the rural drinking water is safe, we combine the power of government, the population and the law.
