Drinking water crisis that are caused by Water pollution and water shortages, are seriously affecting huanman survial and development.Now safe drinking water is concerned by the society. Ensure the safety of drinking water is the request to protect human rights and health, to protect human environment right, to establish good international image. In the city the definition of safe drinking water have two main:water quality and water quantity, but in the rural areas it have four indicators:water quality, water quantity, convenient degree and assurance. Now in China the legal protection of safet drinking water still have many shortcomings:firstly, there is no still effective legal protection in many areasd and the existing law is old, so legislative idea is not incompatible with the development level of economic; secondly, due to the existing drinking water protection laws are scattered in othe rlegislation, so there is often conflict and contradictory between laws; thirdly, in the existing drinking water management system there are many management departments and they are lack of coordination. This is to the disadvantage of drinking water protection; finally, the existing legal institutions have many shortcomings. So our drinking water law protection is still need further strengthened. The United State early as earlier enacted the "safe drinking water act" country, it has established some effective legislation after many changes to the law, for example management system that federal government and the state have clear duties, the istitution of the source of drinking water, the istitution of emergency disposal, the istitution of information openness, the istitution of legal responsibility. Although this legislation has achieved good results in, there are different actual conditions between China and America. We should perfect our drinking water legal protection in accordance with the actual conditions of our country and properly adopt the American legislation. We can perfect our drinking water legal protection from the following several aspects:firstly, we should perfect current laws. We can make the law about the source of drinking water, then make the Safe Drinking Water Act when the time is ripe; secondly, define the principles of safe drinking water and use them direct the legislation and protection of Safe Drinking Water; thirdly, according to Chinese current situation we are not suitable for building new management system, but we can perfect the existing management system in accordance with the principle of efficiency and harmony. Finally, perfect and innovate in existing drinking wate, and make it to be conformity with the protection of safe drinking water.
