Land for the development of a country is great significance.If the food is the foundation of human survival and development,the farmland is grain production base. Sufficient quantity and quality of cultivated land resources is deeply affecting the healthy development of the national economy.Our country population base big,farmland of average per capita is less and the quality of cultivated land, cultivated land protection problem has become our country economy whether development,society whether stability an important factor,therefore,protection of farmland has been imminent.Our country from the twentieth century seventies end begins to pay attention to farmland to protect the job,enacted a series of laws and regulations and to develop a series of legal system,mainly including the land control system,land development,consolidation,land reclamation system,dynamic equilibrium of total cultivated land system,the system of protecting the basic farmland and the criminal protection system.Although these systems on farmland protection work has played an important role,but there are still some defects,such as land management system,the inadequacy of reclamation land quality is not high,farmland occupies filling balance quality,basic farmland protection mechanism is not perfec,land illegal behavior such as sentencing lighter.For cultivated land protection law system all sorts of not perfect,we should constantly improve the legal system of arable land protection,at the same time,draw lessons from developed country experience,make farmland protection legal system more reasonable,to farmland to protect the job to play more important role, in order to promote the sustainable development of China’s economy.This paper has analyzed our country basic farmland protection law system,and focuses on the discussion of these laws is insufficient and perfect.This thesis is divided into five chapters,the first chapter, introduced the topic background,the research goal and the research significance.The second chapter is the resource of our country farmland protection legal system,expounds the necessity of the strict protection of farmland,and introduces the protection of arable land in China legal system history and current farmland protection the main contents of the legal system.The third chapter is part of the national legal system of arable land protection research,introduced the United States,Japan and Britain’s main cultivated land protection law system,and elaborated on the protection of arable land in China and enlightenment.The fourth chapter is the protection of our country farmland to the defect of legal system.The fifth chapter in the fourth chapter of the perfection of legal system of arable land protection suggestion.
