Financial trade service has been grown greatly with the development ofeconomic globalization and liberalization in financial trade. The most significantachievement of Uruguay Round Talking is General Agreement on Trade in Services(GATS), which designed to provide a set of market access and non-discriminationregulations of trade in service globally. In the finance field, the liberalization adoptedby GATS has promoted the openness of financial trade in service trade, however,GATS would never force WTO members to make any commitments in any servicesectors. Every member is entitled to set limitations at service departments or scope ofindustries through negotiation, and make specific restrictions on foreign providers aswell. Due to deficiencies of financial markets, WTO members usually take strictmeasures or regulations in finance industry, those measures adopted by WTOmembers would consider as the main limitations and obstacles for other countries.Under such circumstances, how to evaluate these financial regulations? How tobalance the relationship between financial liberalization and financial regulation andfinancial safety of one country? Those are important aspects about research anddiscussion of financial trade in service under WTO regime.This thesis mainly based on the previous research and analysis concerning WTOfinancial trade service, combined with development situation of Chinese banking cardindustry, and divided into four chapters according to this internal logic order.Firstly, the thesis introduces the definition and classification about trade inservice and financial service according to the viewpoints of international organizations and scholars. In addition, this thesis comments and analyzes the legalframework about GATS under WTO system. The author argues that financial serviceis the most important sector of GATS, and the regulations about financial service arethe guidelines of WTO members when they perform financial service obligations..Secondly, the thesis elaborates the liberalization and regulation about financialservice and its specific contents under GATS, the former includes national treatmentand market access, and the latter includes carve-out prudential doctrine and domesticregulations.The third chapter introduces and analyzes the openness level about Chinesebanking card industry and related situation, and focus on WTO case regarding U.S.electronic payment service suppliers being restricted in China.In the final chapter, the theoretical approaches and suggestions about Chinesefinancial service under WTO were discussed, which manifests that we shall observeWTO rules completely, and for another, we shall make use of WTO rules to protectdomestic financial market. Finally, the thesis gives the author’s thoughts concerningthe competitiveness of China’s financial service from the perspective of governmentand enterprise two levels.
