Research On Legislation Integration Of Environmental Protection In Bohai Rim Region

Economic Globalization is a major trend in the development of international economy, so does the integration and coordination of Regional Economy. With the full practice of Chinese Regional Development Strategy, Bohai Sea, North Bay, and the West Coast of the Strait are growing after the formation of the Yangtze River Delta and the Pearl River Delta. All of these regions have a big potential of developing which makes their ecological situation related to the crisis about the Yangtze River, Yellow River, Liaohe River, Haihe River, Pearl River and the vital area of the coast of Bohai Sea, North Bay. Whether the ecological environment of these areas protect well have key influence with the mid long term evolution of the most dynamical coast in China. The economy and environment in Bohai Sea has drawn our most attentions.Based on the conflict of legislation between centralization and decentralization in China, and the background and the status quo of environmental protection in the Bohai Sea. this paper will draw on the experiences at home and abroad, we’d like to find a way to establish a integrated legislation process in environment protection. The concrete is divided into five parts.First is the introductory remarks, mainly about the background of the environmental protection of legislation integration in Bohai Rim Region. Beijing. Tianjin, Shandong. Hebei, Liaoning. the five provinces and municipalities around the Bohai Sea, play a decisive role in China. Bohai Rim Region, with its comparative advantages in superior geographical location, rich natural resources, steady economic fundamentals. strong technological strength and the formation of urban agglomerations, has become the "engine" of northern China’s economic development, and hailed as a third of China’s economic "growth pole" by economists. However, the environmental issues are disturbing while the economic is developing. The quality of marine environment is getting worse and worse, the marine ecosystem is severely damaged, varieties of disasters have been occurred frequently. The contradiction between the Bohai Rim region’s rapid economic development and environmental protection is aggravating. Economic growth is constrained by the resources and the environment more and more obvious. Economic development is increasingly subject to the ecological environment. The legislation of environment protection in Bohai Rim Region is also intermingles with the good and the bad.The next part deals with the necessity of the environment protection of legislation integration in Bohai Rim Region. National laws, such as the Environmental Protection Law, can not meet the regional demand. The public nature and specificity of the natural resources require breaking the administrative division in regions, carrying out regional cooperation, proceeding joint control of pollution and protecting the environment. Starting with the whole development of the Bohai Rim region, the integration of environment protection legislation and the realization of the integrated environmental protection is the only way to obtain a regional sustainable development. It will build a good ecological environment for regional economic development and enhance competitiveness of the Bohai Rim region. By the comparative analysis of the rules and regulations in the Three Provinces and Two Cities, it points out the conflicts in local environment protection legislations, such as Legislative style uncoordinated, the inconsistencies in regulatory content and the difficulties in some provinces legislated in advance.The third part is to investigate the legislation integration mode about foreign regional environmental protection and it’s revelation to us. Focused on the United States’Congress unified legislative mode and interstate contract in Tennessee Valley Authority (TVA), the joint system of cross-regional government of Japan and the management of the Rex Seto Inland Sea. This part also introduces the North American Free Trade Area(NAFTA),which is a kind of international and regional organization, you can find out how it coordinates environmental issues among member countries. We will obtain significant experiences to China by investigating and evaluating process.The last part is important in this paper. It is about building the path of legislation integration of environmental protection in Bohai Rim region. In theory. Regional Executive Legislation Mode and Consultation Mode are relatively mature, but they have inherent flaws. Authorization Mode combines the above two. while maintaining the stability of the existing framework, it also has the binding effect of regional legislative cooperation. Authorization Mode is also suitable to Bohai Rim region’s characteristics.In order to build Authorization Mode of legislation integration of environmental protection in Bohai Rim region, we must pay attention to coordination on authorization decision, bill drafting, scrutiny of bills and other links in the procedure. In essence, by the special authorization of the Standing Committee of the NPC, the Authorization Mode of the consultive reginal coordinate legislation must carry out for the purpose of freedom, equity, efficiency, order, clearly define the rights and responsibilities of the people’s congresses, governments, businesses and public. We hope that the model will be efficacious to improve the regional environment, improve people’s quality of life, promote social equity and fair.
