Marxist legal equality concept is the first principle of Marxist legal thought, which runs through the whole process of the formation and development of the system of Marxism legal though, it is an important and indispensable part of Marxist theory. The law is due to the emergence of the unequal social relations, and provided the impetus for the development of equality. Marx founded his own legal equality concept system, which departure from historical materialism and dialectical materialism, before people’s thinking in order to draw. Marx legal equality concept reveals rational true meaning of the legal equality.This paper discusses the course of development of Marxist legal equality concept, which through the excavation of Marx legal equality resources. Marx analyzed economic relations of capitalist society which is the labour thought of alienation as the starting point,And revealed deep-seated reasons of legal inequality is the private ownership of production. On this basis, Discussed the basic characteristics and the main content of the Marx legal equality of the thinking:Marx believed that legal equality is the proletariat’s legal concept of equality, which established on the basis of public ownership of the means of production, reflecting the will of the masses of working people, be the rights and obligations of the unification of substantive equality and formal equality of unity. It includes content of Legislative equality and the course of justice and fair law enforcement. That is to the Marx legal concept of equality as a guide to what to construct the contemporary the Chinese legal equality system which from three aspects of improve the legislation, strengthening the judiciary, and the erection of legal authority, And should safeguard the people’s right to political democracy, and his all-round development to provide political protection and ensure the social distribution of the relative fair comprehensive development of man’s economic security and protect the rights of vulnerable groups, in order to fully achieving de facto equality.
