In the network information age,“Information ismoney”. Therefore, the trade of information has become animportant part of information industry. Chinese governmentand other information-processing institutions hold a greatdeal of personal information, which has the danger of thedisclosure, distortion and misuse of personal information,so it is the blind spot of personal privacy protection. Atpresent, the study of personal information protection in theacademic circle is still at the initial stage, the awareness ofpersonal information protection is not strong, and eventhere is no specific law to protect people’s interests and toregulate the behavior of information users, which lead tofrequent violations of rights and interests of personalinformation. That is clearly a short board in theconstruction of rule of law in China. Therefore, in order toeffectively protect individual interests, effectively utilizeinformation resources, promote healthy development ofChina’s e-commerce and e-government, ensure thesuccessful engagement of Chinese enterprises ininternational investment and trade, promote theestablishment and improvement of government informationopen system, the personal information protection systemshall be developed as soon as possible. After investigatingand studying the personal information protectionlegislations abroad, this thesis incorporates the personal information protection in the dynamic study of the rule oflaw in China, and provide corresponding solutions andlegislative countermeasures to strengthen personalinformation protection.The thesis is divided into six parts. The first part is thebrief introduction, which describes the background, thesignificance of the topic and study methods. The secondpart introduces the basic concept of personal information,through the comparison and analysis of related concepts,which defines the connotation and denotation of personalinformation, summarizes its characteristics and specificallyanalyzes its various classifications to obtain morecomprehensive understanding of it. The third part discussesthe relationship of the personal information protection andthe construction of the process of rule of law. The theory ofrule of law provides theoretical support for the protectionof personal information, which is an inevitable requirementof a legal society. The fourth part analyzes the status quo ofthe protection of personal information in China, whichdescribes the improvements, defects and deficiencies of thepersonal information protection, and analyzes the causes ofthe problem with certain data and cases. The fifth part iscomparative analysis. It compares and analyzes thepersonal information protection system in Germany, theUnited States, and Japan in terms of the legislative purpose,modes of legislation, legislative basic principles andindustry self-regulation and other aspects, which provide references and lessons for the personal informationprotection in China. The sixth part puts forward with anumber of ideas for the improvement of the protection ofpersonal information in China, according to the objectiverequirements of promoting rule of law in China.
