The Theoretical Basis And Development Of Community Correction System

The community correction system was originated from the court practice of England, America and France, and it is the major content of punishment execution. Community correction system adapts to our country’s new idea of "social management innovation", and it carry on the responsibility of maintain public security and helps criminals back to the society, at the mean time, as the punishment and supervise measure, community correction is being adopted by many countries because of it protect the criminals’right, lighten the national financial burden, and optimize the allocation of social resources. Our country started pilot job from July2003, every trial community has formed their own pattern according to the local character, what’s more,<amendment to criminal law (8)> has brought community correction up to the level of law.<Implementation measures of community correction> which was carried out in March2012clarified the operability of community correction. However, when we make a general survey on this community correction system, there still a lot of problems which worth thinking.This thesis sorted out and analyzed base on the existing theoretical research, draw the community correction operational status lesson from national and international, and sum up the experience of promoting community correction in our country. It analysis the disadvantages in building up community correction system, like right decentralization in community correction organization, system and rule of community correction are too simple, Specific control measures of community correction is too single and Lack of punishment. By nomological sorting and analyzing to these problems, makes the development of community correction more reasonable and reliable, at the mean time, it provides normative guidence for how to carry out the community correction implement smoothly, and legally, it has certain meaning for deeper the reform of criminal judicial system.
