According to the2011official statistics, there are totally242million farmworkers in China.61.8%of the migrant workers are at the age of16-30,which meansnow there are approximately100million new generation migrant workers in China.Further more, the number is annually increasing by about8or9million. In recentyears, as the city-country integration develops rapidly, the first generation of themigrant workers are gradually going back to countries from cities while their children,the new generation migrant workers, are stepping on the stage where the olds everstruggled.Meanwhile, according to result of the author’s questionnaire survey, most of the migrantworkers’ crimes are committed by the news and the rate of crimes is increasing every year.Therefore, to solve the obstacles of the news’ migration is an emergency.In the view of the extreme conflict-crime, after analyzing the individualcases and the research statistics, the author consider that the new generation migrantworkers commit crimes because they lack guarantee of survival in cities. As the mostdirect reflection of survival is labor rights, the author suggest that the deficiency oflabor rights should be the underlying cause of the new generation migrant workers’crimes. Base on the above discovery, the author will expose the lack of labor rightsfrom the lack of laws and regulations. At the end of the thesis, by means of perfectingthe labor right system, the author will provide some advices on legislation, lawenforcement and judicature to prevent the migrant workers’ crimes.
