| Our Constitution provides for the citizen’s basic rights, rights of citizens shall be protected effectively, the country according to law, build a socialist country under the rule of the basic requirements, and the rule of law in accordance with the law, the first is to be in accordance with the constitution. Confirm, maintain and safeguard the basic right of citizens, is in the process of modernization important objectives and tasks. But as China’s industrialization and the acceleration of urbanization development, the amount of landless farmers increase gradually, landless peasants’rights and interests protection problems increasing attention. In the process of farmers’urbanization became vulnerable groups, its right to how to get security, has important and profound theoretical significance and practical significance. This article take the constitution as the Angle of view, with the basic right of citizens as the main line, landless farmers as the research object, by qualitative and quantitative analysis, the empirical and normative analysis as research methods. First of all in the constitution and the law on farmers’ right to farmers, the constitution protection, the meaning is expounded, and constitutional provisions as the basis for the farmers’ rights to carry on the analysis, that is, from citizens the inalienable rights of life, equality and property rights, basic rights guarantee four aspects, view points of every citizen to analysis the constitution gives the basic rights. Secondly the land-lost farmers lack of security of constitutional rights reasons for the empirical analysis, and then based on farmers’ rights to solve foreign advanced experience, in combination with the actual situation in our country, and on the basis of farmers’right to put forward the construction of constitutional protection mechanism, to overcome the defects of existing law, perfect the relevant legal system, to safeguard the lawful rights and interests of the land-losing farmers purpose. |
