The Study On The Legal Issues Of Multinational Corporation’s Social Responsibility

As the expansion of multinational capital, the contradiction between economic globalization and the social responsibility of multinational corporation has grown, which leads a series of new problems such as the reduction of social responsibility in multinational company. The reduction had a great impact on Economic development of developing country, including China.The main purpose of this research is to deeply analyze the legal issue in the reduction of multinational corporation’s social responsibility, finding the feasible solution and regulatory measures.The first part is to focuses on the background, definition of multinational corporation’s social responsibility from the point of view of law and economic, society and ethics. In the second part, the author evaluated the reduction of multinational corporation’s social responsibility, and also had some recommendations on the double standard of social responsibility. In the meanwhile, the author argues the reasons for the localization of multinational corporation in China.The third part is about the existing international legislative regulation of multinational corporation’s social responsibility. Although much has been done by the international organizations, international custom and multinational corporation itself, there were some disadvantages in the efficiency, content and model. The forth part’s main intention is to introduce the theoretical and practical regulation of multinational corporation’s social responsibility in the USA and EU.The last part of this article firstly analyzed the existing situation of China’s multinational corporation social responsibility, According to authors’ suggestion, that it is crucial to abolish the supernational treatment, establish public interest litigation legal system, perfect the legislation and so on.
