China’s Legislative Evaluation System

China is now in a period of social transition and the growing need for a largenumber of laws and regulations to meet the needs of society, therefore, the numberof legislation is “Legislative Great Leap Forward”, resulting in the decline of thequality of some of the laws and regulations, between the old and the new law, thelaws enacted by different departments,lot of conflicts emerged, these conflicts notonly bring a lot of nuisance to the community, but also damage the authority of thelaws and regulations. The system of after-legislation evaluation is in order toimprove the quality of legislation china explored in recent years. The system ofafter-legislation evaluation refers to "the laws and regulations implemented for sometime,by the legislative branch, law enforcement agencies,the public, experts andscholars.via the qualitative and quantitative analysis to understand the resultsachieved after the implementation of the laws and regulations and found the existingproblems, analyze the legitimacy, maneuverability and pertinency of laws andregulations in order to receive scientific and objective feedback, repairs the defectsof the laws and regulations, in order to better play the role of laws and regulations.This article is divided into five chapters. The first chapter, Begining、development and the value of the system of after-legislation evaluation. This partmainly expounds the base concept, the historical development and the significanceof the system of after-legislation evaluation; The second chapter is the legal analysisof the system of after-legislation evaluation. Analysis the need of the system ofafter-legislation evaluation from the perspective of jurisprudence; The third chapteris introducing the system of after-legislation evaluation of foreign country as well asour reference. Through the analysis and evaluation of foreign country’s legislationsystem, raised an important reference for the assessment system in China’slegislative system. The fourth chapter is the building of the after-legislationevaluation system. This is the most importance part of this article, the assessment system built according to our specific situation in China. The fifth chapter is a casestudy of the assessment system <<Guangzhou City rental regulations>> and<<Guangzhou City rural real estate rights registration>> as an example. This Partis analyze legislation from the perspective of social practice and evaluation system.
