Research On The New Style System Of The Rural Social Endowment Insurance Legal Issues

At present, our country has a certain scale for urban endowment insurance systemresearch; however, our country has not paid enough attention to the study of the systemof rural society endowment insurance. For decades, although the national and local dosome exploration and practice to the rural social endowment insurance system, the effectis not very ideal; still do not form a relatively systematic rural society endowmentinsurance system. The construction of rural society endowment insurance system affectsthe relationship of millions of farmers’ basic life and the national economic, socialdevelopment and stability. Perfect the system of rural endowment insurance, have animportant meaning to the rural social security system construction, the protection of theelderly people in countryside and the problem of aging.In2009, the state council general office announced about "The guide opinion of TheState Council about the development for a new rural society endowment insurance pilot",decided to develop a new type of rural social endowment insurance system, started thetrial work from2009, basic realize nearly complete coverage in2020. This article isunder this context, based on the existing practice and the theory research in the country,borrowing ideas from the domestic and foreign representative rural endowment insurancemodel, absorbing experiences and lessons, and propose related improvement suggestionsaim at the problems which present at the new rural social endowment insurance pilotprocess stage.The main structure of this paper is divided into four parts:The first part of this paper introduces the basic theory of a new type of rural socialendowment insurance. Analyze the basic theoretical of the new rural society endowmentinsurance mainly from the view of economic, law. The aspect of economics mainlyincludes welfare economics theory, Keynes theory. The aspect of law mainly includeshuman rights theory and social justice theory.The second part is mainly introduce to the rural society endowment insurancelegislation of other countries or regions, including Germany, France and other developedcountries and Brazil, as a representative of the developing countries. Through theresearch to these countries’ rural social endowment insurance system to further improving the country’s new rural social endowment insurance system.The third part is the summary of our country’ development of rural socialendowment insurance system in recent years and the analyze of new rural socialendowment insurance pilot, propose the main problems which exist in the new ruralsocial endowment insurance, such as legislative lag, the financing difficulties and lack ofcohesion between related system and so on.The fourth part is based on above parts, proposed legislative suggestion to the ourcountry’s rural social endowment insurance law system and the way to perfect thissystem, but due to some factors such as the limitation of length, the limitation ofcollecting of data, this paper just designs some system from the view of the macroscopicperspective and make a rough planning the future development direction. Expect to notonly further improve the legal theory of rural society endowment insurance in future, butalso support some useful reference to the relevant departments.
