With the government’s management of cost consciousness, sense of service and civic awareness, government Performance is applied in the gradually. In the seventies of last century, Some western countries introduced performance, carried out a lot of legislation, and has formed a relatively complete government performance evaluation system, and achieved positive social effects. After10years of practice, our government has the initial development of performance evaluation, but there are still many problems. Such as the lack of legislative protection, no effective supervision, rights remedy system and accountability system is imperfect. Regarding the performance evaluation, most scholars research from administrative science and public administration, few studies from the perspective of law, making the lag in legislation. In turn, this affects the government’s performance. Purpose of this paper is to provide a theoretical support for legislation for a scientific and measurement system. This structure has four parts:The first part theoretically explains the legal system of the government performance; The second part analyzes the reality of the legal system of the performance of our government, particular problem. The third part analysis the legal system of government performance of the United States, Britain, Japan and Hong Kong. The fourth part put forward the proposals to improve the legal system of the government performance, including promulgating the government performance act, making standard procedure of relief program established, establishing relief program of the government performance. This paper use empirical and comparative research methods, and a large number of government performance evaluation theory and practice. To solve these problems, I believe we should enacted laws, establishing the right to assess, building assessment procedures and relief system, in order to keep our government’s performance assessment developing.
