As the boom of internet, while people enjoy the great convenience of it brings, they also face the problem of infringement which never happened before and very difficult to be resolved under current legal systems. The most common and influential one is copyright infringement on internet. The definition, classification, punishment, as well as preventing method of network copyright infringement, have been hot topics in recent years, international and domestic legal issues. With the continuous improvement of laws in our country, many scholars and experts are on the network copyright infringement legislation to make some useful exploration and reflection. But with the rapid development of the internet, problems arises dramatically. It is inevitable that their thoughts are still inadequate.The first part of this paper gives the basic introduction of the research background. Network copyright infringement, as an emerging legal issue in recent years, have attracted a large number of scholars to do significant research work. However, domestic legislation, compared with developed countries, has congenital and acquired deficiencies. Cases with significant impact still trigger divergent views, nor authoritative monographs or special laws have been provided. This is also one of the important reasons for this paper to choose this topic. This section also studies the explains the research content and research methods.The second part introduces the time background, concepts and characteristics, classification and expression forms of the network copyright infringement. Only by clarifying the meaning of the network of copyright infringement can the legislative norms be targeted and precise.The third part briefly describes the relevant legislation of internet copyright infringement, such as the TRIPs Agreement and the Internet Treaties, the regulations of the United States, the European Union, Australia and other developed countries. An evaluation and analysis of these regulations has also been given.The fourth section describes2classic cases of international copyright infringement. Developed countries introduce the Internet earlier than China, but also face earlier network copyright infringement. Foreign precedent thus has a very important reference for China legislation.The fifth section provides an overview of the legislative status quo of China’s copyright infringement on the network from administrative, criminal, civil and technical aspects.Part six put forward comments and suggestions on the copyright protection under the network environment in China.
