With the rapid development of transgenic technology in recent years has been widely used in the fields of agriculture, medical, given the infinite hope to solve hunger and disease while and buried many worries about our survival and development.According to statistics, China is one of the world’s most biologically diverse country, the species reaches approximately10%of the global total, ecosystems and genetic diversity in the world. While all sectors of GMOs security still exists heated debate, but only released by the scientists genetically modified biological cause of the ecological environment of the potential risk of data should cause our Chinese existing considerable number of transferred genes biological may lead to the biological safety attention.Facing the scientists experiment given as much of the data, we have to worry about, such as scientists:the environment, human or other interests of genetically modified organisms in the laboratory to be released to the ecological environment for human survival, and really put realistic and potentially dangerous. With this sense of responsibility for the respect of life and the environment, many scholars in various fields from various research side of the safety issues of genetically modified organisms are thinking and values more in-depth research, we understand learning provides a rich academic resources. So far, the problem is expanded from ecology, ethics of science and technology, environmental science, specific performance applications expertise to explore the biological safety of genetically modified organisms initiator, such studies generally confined to their respective specialized area of research. But along with the further development of transgenic technology, genetically modified products gradually moved into the homes of ordinary people, we found that the safety issues of genetically modified organisms is a comprehensive research project, so turn the security problems caused by genetically modified organisms on the nature and human society not, as everyone expected before the like that rely solely on self-improvement technology can be circumvented, at least for now it seems, this idea is extremely unrealistic.The safety of genetically modified organisms in the external view, across the natural sciences, such as biology, bio-engineering and other involved in the ethics of science and technology, environmental ethics, law, management, social science research from the law is concerned, the question of the safety of genetically modified organisms must start from the discipline of environmental law, international law, administrative law, so the study of the problem of the safety of genetically modified organisms help establish and improve the theoretical system of legal and institutional system, but also to enrich and improve the environmental law theory and institutional system has great theoretical significance. More realistic, the study of genetically modified organisms safety concerning a basic human right to life and health, therefore, issues related to the safety of genetically modified organisms study has important practical significance.With transgenic technology research and commercial development of genetically modified organisms, GMOs safety field existing legal order, systems and theories have been unable to resolve many of the problems that have emerged in reality. So, how should through its own integration and even reconstructed to create the framework of the legal system, a set of genetically modified organisms safety system, pressing practical problems facing the legal community today.From the point of view of law practice, so far, the international law and domestic law have been in a different level made some adjustments and changes, but these efforts are still far from enough to solve the problem.In the first part of the introduction, mainly on GMOs in the global application and development status conducted a brief description, and then combined with the actual situation of our country related to the safety of GMOs legislation and regulations of, reveals our turn gene bio-safety legislation of the necessity and urgency of sexual; second part of GM technology transfer genetically modified organisms and the safety of GMOs, the concept of genetically modified organisms safety legal system’s conducted a simple Discrimination, and turn genetically modified organisms may produce the security problems of mainly made a brief overview, the last legal regulation of transfer genesbiosafety reasonable basis as well as the value of the measure made a brief analysis of learning to lay a foundation for further study of the legal system on GMOs safety; third part through the study of international conventions, the European Union, the United States, Japan, legislation and regulations relating to the safety of GMOs,these legislative brief assessment, construction of the legal system in order to obtain useful experience. Part IV and Part V specific from our existing GMOs relevant legislation and related legal system, such as genetically modified organisms safety assessment system, the labeling system of GMOs, GMO import safety approval system for genetically modified organisms and their products trigger disputes liability system, the legal system according to the situation of our country, Drawing on the lessons of the relevant foreign legislation, summed up the main problems of the existing legislation and its system, and based on national conditions, may propose appropriate improvements targeted suggested benefit strive for the perfection of the legal system of the safety of genetically modified organisms.
