Genetically modified organisms (GMOs) are the living organisms which are new combinations made of genetic material through modern biological technology. Taking the fact that the safety problems of the GMOs have not been confirmed scientifically into consideration, they could cause uncertain risks to the heath of humans, flora and fauna and the environment.The Convention on Biological Diversity and its protocol are the main international laws in the transboundary movement of GMOs. The convention makes the rule from target to implementation mechanism on the transboundary movement of GMOs, and is important in risk prevention principle, advanced informed agreement procedure etc. The international legislation on the safety of GMOs needs to be improved because of the application range limitation the advanced informed agreement procedure, deficiency of damage liability and the absence of the GMO export countries. As part of the international trade, GMOs surely are involved in related rules of WTO. The Convention on Biological Diversity and its protocol have some conflicts with the WTO rules. The convention has some differences in the application procedure in the dispute settlement mechanism. In addition, the two have other concrete conflicts in the regulation rules. These problems lead to the safety risks of the GMOs, and have some impacts on the biodiversity protection. Therefore, suggestions on the international law improvement on the safety of GMOs are very necessary.Through normative analysis and case analysis, this paper mainly researches on the related contents on the WTO multilateral agreement, and conducts demonstration on the related cases form theories to practices. At the same time, some suggestions on the legislation improvement on the safety of GMOs are given.
