On The Children’s Basic Right To Legal Protection And Improvement

Basic rights of children is not a long time our theoretical study, affected by the traditional laws and basic rights of children had not received sufficient attention, or even ignore. In this paper, starting from the point of view of protecting the basic rights of children, highlighting the fundamental rights of children to absorb and learn from the success of the legislative experience of developed countries for the basic rights of children-related issues, and offer some suggestions.This article is divided into the following sections:The first part of the concept of fundamental rights of children and their characteristics described. Mainly divided into two aspects, the first aspect is to introduce the basic situation of our country at this stage of our children the legal protection of fundamental rights The second aspect dealt with the problems of legal protection of fundamental rights of our children, this area is mainly from the four perspectives described including the concept, legislative, administrative protection and judicial relief..The third part is to improve the protection of fundamental rights of our children the basic path of the legal system. Mainly from four aspects to improve, first, to establish the principle of "best interests of children", the second is to improve the basic rights of the child protection legal system, three is to improve the administrative protection of fundamental rights of children, four of them is to improve the judicial protection of fundamental rights of children.
