With the rapid development of real estate, property management industry hasgradually developed, become the daily lives of people with the industry. Because nomatter what people in the home, as long as the return to the home, they all have acommon identity——the owners. For today’s owners, for the house is not only theexchange area, more important is to change the living quality. The key and let theextra off live in property management. Can say, there is a trend, the property isexpected to replace the distance become important support prices, there is a fact,property management, community harmony, social harmony.However, the property management in the development process has shown manyproblems, so a large number of property management disputes, the interests of ownershas been destroyed. In this situation the need to perfect our legal system of propertymanagement. The legislation, the legal basis is the "property managementregulations" authoritative and professional, enactment of the Ordinance is a milepostsignificance, marking the property management in our country started. In addition tothe "people’s Republic of China Property Law","property management services","city of new residential area management approach","special housing repair fundsmanagement approach","property management enterprise quality managementapproach", and the new promulgation of the "security service managementregulations","owners of the general assembly and the owners of the Committeeguidelines" etc.. Although our property management legislation system has begun totake shape, but still exists many problems, coupled with the awareness of propertymanagement is not enough, which requires us to further study the theory of propertymanagement better, improve the legislative system, property management norms, tofully protect the legitimate rights and interests of owners and property ServiceCorporation. Property management is to achieve the unification of social benefit,economic benefit and environmental benefit. The quality of property managementowners can make full use of the immovable property, is conducive to maintaining social stability. Therefore, based on the practice of property management as the basis,through the discussion of the property management of the legal system of our country,puts forward the measures and solutions, to better guide the trial practice.This paper is divided into four parts, the first part introduces the basic problemsof legal system of property management, discussed to lay the theoretical foundationfor the following. The second part gives a brief introduction to foreign countries andHong Kong and Taiwan property management legal system led to some foreignadvanced theories and practical use for reference to china. The third part discusses thelegal problems of property management system, separately from the propertymanagement legislation, the government department in charge of industry regulation,the proprietor’s autonomous organization system, special housing repair funds andother aspects, this paper puts forward some main legal issues. The fourth part thethird part of the in-depth study, put forward to solve and improve strategies andmethods, including new suggestions as reference.
