| Wetland is located in the transitional zone between the terrestrial and aquaticecosystems, which is widely distributed all around the world. It is an important areaof river ecological protection, which has powerful purification function with fixedpollution, purifying water ecosystems on earth, and it plays a significant role inecological balance. Our country is quite rich in wetland resources, wetland has beenplaying an important role in environmental protection for a long time. In recent years,the wetland resources development is not reasonable for the reason of the blindpursuit of economic growth, all kinds of environmental problems come one afteranother. In order to better protect wetland resources, reduce the occurrence of naturaldisasters, China began to attach importance to the protection of wetland and do somesubstantial efforts on protection of wetland ecological.Currently, the relevant departments of the State has issued some regulations onpolicy level and the legal aspects, some local governments also tries to make somerelevant regulations and measures, and these measures on wetlands protection mayindeed make some difference. But if we really want to achieve the purpose ofprotection of wetland resources, it’s really not enough. Practice has proved that thelegal method is the most effective method for wetland ecological environmentprotection. But until today, at the national level, there is not any specific law onwetland protection, just like forests and oceans, which has weaken the supervisionand protection efforts at some extent. For this, the relevant legal department and thelegal profession must make joint efforts to establish the wetland ecologicalcompensation legal system as soon as possible, realizing the purpose of protectingwetland ecological resources. In this thesis, the author elaborates the connotation ofthe wetland ecological compensation, the need to establish legal system, thetheoretical basis and the status; and trying to make the simple idea on establishing thelegal system of wetland ecological compensation, aiming at making the modestcontribution to the establishment for the legal system of wetland ecological compensation.This addition to the introduction and the conclusion is divided into four parts. Inthe first part, the author make a conclusion that China’s official Convention onWetlands of wetland concept is more conducive to the protection of wetland resources,by giving the inductive analysis of each subject of different perspectives on theconcept of wetlands. Because the wetland resource has a role that cannot be ignoredon the ecological environment in our country, and the protection of wetlands and notenough attention, which leads to the wetland ecological compensation systembackground, and its connotation, necessity and principles are described, that theestablishment of wetland ecological compensation system is imperative. In the secondpart, the author mainly introduces four theoretical foundation of wetland ecologicalcompensation legal system, including the ecological environment value theory,externality theory, public goods theory and the theory of sustainable development.These are the basic theories for the establishment of the wetland ecologicalcompensation legal system. The third part is the emphasis of this article, it firstlyelaborates the relevant regulations of our country on the wetland ecologicalcompensation policy provisions and legal level. In order to achieve the purpose ofprotection of wetland resources, it’s necessary to establish and perfect the legalsystem of ecological compensation. Secondly, it introduces the practical difficultiesencountered during the establishment of wetland ecological compensation legalsystem, including the technical aspects of legislation, management system level,compensation system level and environmental awareness levels. The fourth part is thepriority among priorities in this paper, it further elaborates the practical obstacles forestablishing wetland ecological compensation legal system that have mentionedabove, and then boldly putting forward suggestions on the establishment of wetlandecological compensation legal system according to the problems. |
