The Research On The Legal System And Perfection Of Wetland Protection In China

Wetland resources is very rich in China, but this kind of resources suffer from pollution and production activities of intrusion and destruction frequently. If we don’t take measures to protect them effectively, the wetland will suffer immeasurable loss. Wetland protection needs a variety of means which legal action plays the most important role. Our country in the wetland protection legislation insufficiency, the related legal system is not perfect, lead to the wetland protection management chaos, law enforcement, public participation is not enough, and many other obstacles to wetland protection problem. In China, the imperfection of legistration and regulation of wetland protection resulted in the occurence of several wetland protection problems, including management disorder,inproper legal enforcement, inadequate public participation, etc. Therefore, to establish a complete and effective laws or regulations about wetland protection and management mechanism, is more advantageous to the development and utilization of wetland resources.In this paper, the induction for the legislation dilemma of wetland protection in China is summed up by means of literature research, system analysis and comparative analysis research, which is combined with the experience of Dongting lake wetland protection.And we also try to find the countermeasures of perfecting our country’s legislation of wetland at the same time.At the very beginning,this paper set Dongting lake wetland protection as an example to analyse the present situation of legislation and the dilemma of wetland protection in China.In the process of consolidation and summary of the Dongting Lake wetland’s ecological value and present situation, and their applicable laws and regulations, legislative status and management, to summarize the current wetland protection legislation defects and management problems by making a comparison of wetland protection in China.Afterwards,this paper introduced several foreign developed countries of the legal system of wetland protection to analyze its significance of wetland protection legislation in our country.For the current plight of wetland protection in China,this paper puts forward the legal countermeasures to improve wetland protection on the basis of the analysis on the status quo of China’s wetland protection law system and the learning from foreigh advanced experience in wetland protection.The paper argues that, the first step to perfect our legal system of wetland protection is to build up and to center on the concept of ecological wetland comprehensive legislation framework. In the scientific, harmonious and unified legal system, change the factors of wetland type management system, to be adapted and wetland ecosystem, multi-sectoral participation in decision-making mechanism, clear authority, ensure that law enforcement capacity. Finally, constructs the wetland protection regulation system by using a variety of adjustment method in order to carry out the supervision on the legislation of wetland protection, and to give strong support, forming strong added strength.
