Study On The Legal Problems Of Housing Security Of Migrant Workers

Modernization brings plenty of migrant workers who create huge amounts of social wealth to towns. However, due to the lack of education, they often choose to enter the labor intensive industry which can only offer them small amount of wages. These low-income workers are not accepted by the urban society and also unable to enjoy the same social security rights with urban residents. Social housing in urban areas are not provided for the migrant workers ever since a long time ago, the poor housing conditions and the expectations of migrant workers form a strong contrast which brings labor shortages in mainland China. The labor shortages warns government and enterprises, and let the society begin to pay attention on housing problem of migrant workers. On February20,2013, the final State Council meeting of incumbent government required that before the end of2013, eligible migrant workers should be included in the housing security system of all cities at and above the prefectural level. It is the first time the government put forward policies that aim at the housing security of migrant workers in the whole country, which indicates that the housing security program has begin to focus on migrant workers who have urgent requirements. However, there will be a long way to go when establishing the housing security system, which demands integrated planning of the government and cooperation with the social forces.Considering this, the thesis tries to study the problems of the housing security of migrant workers on the legal perspective, hoping to provide basis and assistance to the construction of the housing security system of migrant workers through both analyzing theory and reality. The entire text concludes four parts. The first part first defined migrant workers based on constitution, civil law and economic law, then introduced the current housing situation of migrant workers as well as the present housing security system of our country, finally summed up the extant housing problems of migrant workers. The second part attempted to discuss and study the housing security problem of migrant workers on the legal theory’s perspective. The thesis first provided theoretical basis for the housing security of migrant workers through interpreting human rights and right to housing in constitution and civil law; then analyzed the various kinds of legal relationships in housing security of migrant workers. The third part explained the necessity of housing security of migrant workers and pointed out the reason for housing security problems of migrant workers. The final part put forward proposals and measures for the establishment of housing security system of migrant workers based on the theoretical research and discussion above.
