The Research On Chinese Legislation Anti-Separatism

For a long time,our country is faced with a severe situation about anti-separatism and anti-terrorism.Especially in21century,severe national splittism activities and terrorist incidents have frequently occurred.Facing the actual harm of the national separatism and the terrorism and their potential threat for a long time,our country need to take a series of long-term and effective measures to respond and legal way is an important aspect among them.But now,the legislation of anti-separatism is still not perfect.It can not meet the need in the judicial anti-separatism practice.So it is necessary to do related research for the legislation of anti-separatism.In order to do good research about anti-separatism,the first chapter defines the concepts related to the legislation of anti-separatism. First of all, Combed the important definitions of separatism and national separatism from academia.On this basis, the author tries to put forward the concept of national separatism crime:national separatism crime refers to that aiming at dividing the country and achieving political independence,tightly organizationally manufacture and implement a series of destruction and violent crimes to through using the national,social,and religious matters as an excuse.Afterwards,pointed out the concept and characteristics of the anti-separatist legislation in our country, distinguished that from anti-terrorism legislation, anti-secession law and other similar legislation, etc, and further clarified the regulating objects about anti-separatism laws and its unique role in the ant-separatism.Anti-national separatism legislation in our country also has a sufficient legal basis,the reality basis and policy basis, which of those have provided the necessity and feasibility for anti-national separatism legislation.The article also do some research about many countries which are facing with severe threat of secessionism and have implemented effective legal measures to respond.Described the anti-secessionism situation in these countries,combed the current anti-secession legislation of all countries,introduced anti-secession legislation mode of multiple countries,and elucidated the judicial practice of the anti-secession in those countries.Other countries’ experience brings important enlightenment and reference significance for our country’s legislation of anti-separatism.Then analyzed the main content of the the current anti-secession legislation of our country respectively from two aspects of domestic law and international law.On this basis, pointed out the insufficiencies of legislation anti-separatism in China, and pointed out that the difficulties of the anti-national separatism in legislation based on the current condition in our country.Finally, the author tried to put forward beneficial suggestions to perfect our country’s legislation anti-separatism in view of status quo of legislation anti-separatism in China as well as the the difficulty of the legislation.
