Online Shopping is become an important part in our life. It is easy to found thatconsumers and businesses status changed behind the rapid development of onlineshopping. More and more people found the potential of online shopping, and begin tobuild a online shop to start their Business activities. In China, the huge numbers ofInternet users makes that unbelievable Numbers people who take part in onlineshipping. Because the huge number of online shopping user, the online shoppingdisputes has became the focus of society. Especially,protection of consumer rightshas been attention by the society and academic research.On the other side, with theincreasing of online shopping consumer rights and interests maintenance calls,merchant’s status doesn’t be concerned as to the consumer. Especially to merchant,malicious complaints and fraud in Online shopping is very common in their businessactivities. Maintenance of rights in internet is so hard for merchant. In china, lawabout online shopping is still use the old law, which is to adjust the traditional trading.The content about to protect the right of merchants is almost blank. In the process ofstudy, Author using the Proof method with combination of theory and practice.Discusses the necessity of the merchant right protection, and put forward theperfection of relevant measures.Article is divided into four chapters. First chapter is about the main types ofNetwork consumption. In order to B2C and C2C as the key point, author introducedthe Management form and merchants in details. In the first chapter of the second half,author analysis the different with the contract format in online shopping andtraditional trading. According to the legislative situation, author analysis theImplementation process and effectiveness of the contract.In the second chapter,through examples to indicates that at present the networkshopping development tend to the consumer. In the other hand,Merchants difficult toprotect their rights. By explicitly classification,Found the main mode of Merchants right infringed,and put forward solutions to make matting for later.The third chapter,author combined with the social development and the tradeprotection measures in our country. Analysis the reason of High consumer status andlack of Merchants protection, authors study consumers, third party network platformand public opinion as a starting point, and find ways to improve the legal status ofmerchants.In the chapter four, as the last part of the paper, author will combine the westernlegal content about Internet shopping to analysis of the legal gaps in the onlineshopping in our country. At last, author combined with the characteristics of theInternet, improvement Suggestions on how to better safeguard rights and interests ofmerchants.
