An Analysis Of The Current Situation Of Villagers’ Committee’s Function Performance

Among the most of rural governance structures of China, the Village Committee, since its emergence, has always been playing the key role and the core strength of the implement of villager autonomy system. The villagers autonomy management mode in villages and pasturing areas has been affirmed and solidified at the legal level since the promulgation of the Organic Law of Village Committees of People’s Republic of China <trial implementation> in1980s. In2010, the promulgation of Autonomous Law of Village Committees of People’s Republic of China by National People’s Congress standardized and specified the composition, functions and democratic supervision of Village Committee in the process of villagers self-governing. Up to time now, we have found it after years of practical operation that the function of the village committee’s current situation of performance deviated the direction and range of legal provisions to some degree. It is owed to various subjective and objective factors, such as the rural geographical differences, population mobility, county-rural interest structure and new rural construction and so on and so forth. The issues of how to narrow the distance between theory and practice, to standardize and give the rein to the functions of village committee in the villager autonomy theory system, and to form the benign combination between the grass-root practice and national design are becoming the important subjects in research field of rural construction of legal systems.The thesis takes Bai Nijing town of Erodes as an example to research the legal functions and performing actuality of villagers’committee. It illustrates the source of functions and types of villagers’committee from the basic theories of legal functions of villagers’ committee. It also presents the performing actuality of villagers’ committee’s functions objectively, which is based on theoretical model. The thesis proposes thorough advices and solutions through analyzing the reasons of reduction of autonomic function and incompetence of the implement of duty. With the method of step-by-step way, the gap between the current situation of performance and the legal theoretical design of villagers’committee’s function can be narrowed hopefully and will form the organic combination between the national design and grass-root practice. Also it will be an effective way to explore the management of village scientifically.
