Avoiding Or Accepting

In2001, Court Final Appeal, Hongkong pronounced the judgment that the baby Zhuang Fengyuan born in Hongkong with both mainland parents could have the right of abode in Hong Kong. From then on, more and more parents from the mainland go to Hongkong and give births to babies. Therefore, it results in a lot of social effects which causes much attention and dispute both from Hongkong and the mainland societies. By analyzing the history, the present situation, the causes and effect of this "Hongkong babies with mainland parents" phenomenon, this thesis gets some thoughts about whether some measures of the mainland government and Hongkong government are legal or not and gives some advice for making policies towards the phenomenon.This thesis mainly studies the mainland parents of these Hongkong babies by observing, document studying, unstructured interviewing and consulting the Rational-choice Theory, Game Theory, Conflict Theory, the Alternation of Generation Level Theory with the following conclusions. The parents choose to birth tourism to Hongkong mainly because of two reasons. One is that babies born in Hongkong have right of abode in Hong Kong which can avoid the family planning policy in the mainland so that they don’t need to pay high social maintenance fee. The other is that the identity of Hong Kong enjoys better education, medical and other social welfare and more than130countries’ visa-free.The phenomenon of birth tourism to Hongkong has brought widespread social impact to Hongkong and the mainland. On one hand, the births of these babies help solve the serious problems like low fertility rate and population ageing in Hongkong. On the other hand, these mainland pregnant women occupy the beds for pregnant women of Hongkong in hospital and temporarily cause medical service level to drop. At the same time, about20000children have become cross-boundary students, resulting in temporary shortage of schooling in North Hongkong. And because there is not clear data about when and how many of these children will come back to Hongkong, the government has difficulties in making the public construction budget. In the mainland, people are debating about whether these Hongkong children’s parents meet the one-child policy and it causes blame for them not to be fined concerning of the fairness of reproductive rights.In order to appease the appeal of the Hongkong people to stop the mainland pregnant women from going to the harbor to give births, the Hongkong government has limited the reservation quotas for mainland pregnant women and raised the fee for emergency. The next CE Liang Zhengying is committed to his will to completely stop mainland pregnant women from giving births in Hongkong by all means.Birth tourism to Hongkong phenomenon has its inevitability. Even through administrative and legal means to stop it, there will still be "rushing aboard" or "rushing for emergency room" phenomenons and it will cause this kind of phenomenon in the United States, Canada and so on. To solve the problem, the governments of both Hongkong and the mainland should work together to maintain the democracy and monocracy of Hongkong and adjust the family planning policy, strengthen the two cultural fusion so as to correctly guide the mainland parents who want to give births in Hongkong and remove negative effect, achieve win-win cooperation.
