Researching On Cultivation Of Legal Responsibility Consciousness On The Prevention And Treatment Of Academic Misconduct’s Function

Academic misconduct seriously polluted the academic environment, cause socialconscience, and moral bottom line were severely impaired. Academic misconductcaused by malignant competition and academic irrational allocation of resources,serious contusion honest scholar research initiative. It leads to loss of Chineseacademic creativity, academic credibility is reduced, hinder the progress of scienceand technology, and to academia the development of adverse effect.There are a lot of factors that cause academic misconduct: social utilitarianthought influence makes the academic study of utilitarianism, and the excessivepursuit of economic benefits makes the academics deviate from the original direction;the convenience of the network reduces the cost of academic misconduct, andcontributes to the atmosphere of academic misconduct; taking quantification as themain academic evaluation criterion puts a premium on the impetuous mentality andfalse conduct, and because the law is not perfect, causing "no laws may rely on, or itis difficult to rely on the law" state; also because our country is in the period of socialtransformation, the old moral system is failure and the new moral system has not beenformed, and this situation makes moral unable to restrain the phenomenon ofacademic misconduct; academic person’s legal responsibility consciousness is weak,also caused academic people lack legal knowledge and indifference of the legalauthority of the phenomenon.Academic misconduct is a moral problem and also a legal problem, so we cannot just simply manage the academic misconduct from the academic moral andacademic management system, but resort to legal education and compulsoryregulation function to foster academic people’s awareness of legal responsibility, inorder to achieve the purpose of preventing academic misconduct. So this paper wantto take the angle of culturing legal responsibility consciousness education, usingliterature and case analysis method to analyze, on the basic of improving the relevantlaws and regulations of academic management system, and use the educating andforcing function of law to prevent and control academic misconduct.
