Research On Localization Model Of Clinical Legal Education

Under the background of our country’s reform and openness and our country joiningWTO,practical legal talents are very popular to our society.But at present,our legaleducation has been still adopting instilled teaching method in classrooms.And by thistraditional teaching method the legal students are lack of practical ability.So our legalstudents are not up to our society’s requirements.So a new teaching method named clinicallegal education is introduced to our country in September of2000.Clinical legal educationoriginates from the United States of America.It mirrors the medical clinics by which themedical colleges cultivate interns.It advocates studying law in practice andexperience.This teaching method pushes forward the reform of our legal education andfosters legal students’practical abilities.But since this teaching method comes fromwestern countries,there are many problems we must face.How this foreign teachingmethod can be fit for our national conditions better is key details of the thesis.The thesis adopts three research methods such as literature research,comparativeresearch and case study method.The thesis puts forward the solutions aiming at thedifficulties during the localization of clinical legal education such as insufficience of cases,shortage of teachers,lackness of fund and so on.The problem of insufficience of cases canbe solved by means of cooperation with law firms,the women’s federation,organization ofdisability and so on.The problem of shortage of teachers can be solved by means ofinviting judges and procurators to the clinic for part-time teachers.The problem oflackness of funds can be solved by combining practical legal education with the legalclinic.The proposal model of the legal clinic which is fit for our national conditionsshould be the model that is combined with the content and the methods of ideological andpolitical education,possesses scientific evaluation and emphasizes on lauching legalpractical bases.In theoretical aspect,the thesis provides theoretical reference to our county’s researchon localization model of clinical legal education according to the countermeasures thethesis puts forward aiming at the difficulties during the localization of the clinical legaleducation.In practical aspect,since the thesis puts forward the specific operation ideas,theclinical legal education can be more suitable for our national conditions.
