The Research On The Application Of Expert Evaluation Mechanism On Disputes Of Compensation And Resettlement For Housing Demolition

Urban Housing Demolition is an essential part in the national urban constructionand the transformation of the old city, and the demolition will involve inmulti-stakeholder, which inevitably will bring a series of conflicts and disputes in thecompensation and resettlement for housing demolition. The conflict of interest of urbanhousing demolition has become a sensitive social issue, while the existing disputeresolution mechanism can not resolve the dispute satisfactorily which has become themain unfavorable factors to the development and stability of our Community. Therefore,we need a mechanism to resolve the dispute of compensation and resettlementimperatively.This dissertation focuses on the analysis of disputes of compensation andresettlement for housing demolition by the way of survey research, evolutionary gametheory and Pareto improvement. The disputes in house demolition caused a lot of socialproblems because of the tardiness in resolve. Through the investigation, we learned thatthe main dispute is the compensation and resettlement disputes. The source of thegeneration of the dispute is our system and the policy of removal, the weakness of therules, non-standard demolition assessment and the limitations of dispute resolutionmechanism. According to the characteristics of the disputes of compensation andresettlement, expert evaluation mechanism which can effectively protect the interests ofthe residents in housing demolition just can fill the existing defects in demolitiondispute resolution by draw on construction contract disputes resolution mechanisms.The necessity of using expert evaluation mechanism to achieve the necessary conditions for Pareto improvement in the distribution of benefits of the housing demolition can beverified by analysis of the evolutionary game model of the benefits and risks of theGovernment and the residents in housing demolition. The results of empirical analysisalso verified that our reference to the necessity of expert evaluation mechanism toresolve compensation and resettlement disputes of housing demolition.Using expert evaluation mechanism is the necessary conditions in the distributionof benefits in the housing demolition in the hope of resolving the compensation andresettlement disputes timely and reasonable. Housing demolition can give everyone allbenefit rather than aggravating the source of contradictions and conflicts between thegovernment and the people.
