In order to control the scale of construction land and ensure our country’s food security, China now implements the most stringent farmland protection system. Although the current planned management of construction land works in a certain extent, the efficiency of land resources’allocation is still low. In order to protect and make full use of land resources, many countries do lots of research and exploration on land development rights system.This paper is to study land development rights’transfer and exchange in China in the aspect of construction land. The main contents are as follows:First, summarize the theories and practices of land development rights both at home and abroad, and establish the framework for studying and analyzing; Second, build Cobb-Douglas production function model, and estimate the marginal production of construction land in each province; Third, build GAMS nonlinear programming model to simulate the inter-provincial transaction of constructional land index, estimate the transaction size and the promotion of efficiency, and assess the feasibility of inter-provincial transaction; Fourth, build China’s inter-provincial transaction market of constructional land index, study specific institutional arrangements and related measures, explore the models of land development rights’transaction which are suitable for China.The main conclusions of this paper are as follows:(1) The marginal productions of construction land between provinces differ greatly, eastern provinces’marginal productions are higher than central and western provinces’marginal productions; The allocation of construction land between provinces is not optimal, and there is still so much space to improve.(2) Constructional land index transfers from provinces with low marginal productions to provinces with high marginal productions; The transactions of constructional land index could increase the total output of all provinces; We can identify which province is index sending area, and which province is index receiving area, and we could estimate the scale of inter-provincial transaction.(3) Building China’s inter-provincial transaction market of constructional land index is feasible in terms of economy, institution and practice. This paper also discusses the design and innovation of basic land institutions, implementation path, related measures.
