It’s always been a hot debate among the international economics theorists and in the international policy negotiation area that if the intellectual property protection can promote the economic growth of developing countries. China, especially as a large developing country, on the one hand is facing heavy pressure from international cooperation after joining WTO and striving for rapid economic development by changing the economic growth mode and encouraging the independent innovation, in line with the inevitable trend of economic development, on the other hand, need to bear the negative influence on our welfare by the stronger intellectual property protection. Our government set the intellectual property strategy lacking a strong theoretical basis, therefore, it’s necessary to carry a research on the impact of intellectual property protection on China’s economic growth. Human capital, as the basic input of R&D department, is playing an important role in the science and technology innovation and diffusion. Moreover, the level of intellectual property protection may also effect the human capital allocation, therefore, it’s also necessary for a research on how the human capital influence the promoting impact of intellectual property protection on economic growth.This paper focuses on intellectual property protection, human capital and economic growth. It’s found problems existing in China’s IPR system basing on research of the current situation. It makes an analysis of the impact of intellectual property protection and human capital on economic growth, by theoretical analysis of three department economics system, which is basing on the hypothesis that developing countries has the independent innovation ability, the technology imitation of both domestic and abroad may both help the knowledge accumulation, the variable of imitation ability, related to the human capital, is different from the variable of intellectual property protection. Moreover, it carries a panel data empirical analysis to prove the results of theoretical analysis, using28provinces data of China. Based on the above analysis, it explores some suitable solutions to develop China’s intellectual property system.The theoretical analysis and empirical analysis both go to the conclusion that the current level of intellectual property protection is helpful for economic growth, and human capital accumulation can boost the promoting effect of intellectual property protection on economic growth. The conclusion of theoretical analysis is that there is a critical value of intellectual property protection. When the level is less than the critical value, intellectual property protection is conductive to the economic growth, encouraging the human capital flowing to R&D, and having a active effect to the promoting impact of IPR. The conclusion of empirical analysis is that the promoting effect on the economic growth is different among different provinces because of different level of intellectual property protection and human capital. In conclusion, China, as a lopsidedly developing country need carry different policies to develop IPR. In addition, China should focus on human capital accumulation, especially the middle and west provinces, to fulfill the goal of China regional economy coordinated development.
