The Influence Of Economic Development On The Level Of Intellectual Property Protection

Intellectual property protection is the academic difficulty and hotspot of juridical practice in the field of law. Currently, studies of this field still stay on the prevention and treatment of the infringement phenomenon. However, compared with the field of law, the economics research has a different point of view. From the view of economics, the study of intellectual property protection is prospective. Nowadays, China is in the key stage of economic transition. It becomes an important subject to study h ow economic development promotes the intellectual property protection. Besides, from the view of regional economics and in combination with Chinese practices, the study of whether there is an important relationship between different regions’ economic development level and the intellectual property protection is theoretic and practical significance.Based on the perspective of economic development affect ing the intellectual property protection, firstly, this thesis sorted and analyzed the domestic and international literatures about intellectual property protection. Then it made a theoretical analysis on the economic influence factors of intellectual property protection according to the division of country, regions and provinces. Finally, it took a level measurement and an empirical analysis on the economic factors of intellectual property protection.On the part of calculating intellectual property protection level, this study uses correction formula of intellectual property protection level to compute every province’s level, and divide all provinces into three regions, namely, the east, west and middle region, to compare and analysis them. The result proves that on the one hand, from the year 2001, the intellectual property protection level s of all provinces in our country are all at rise, and amending <the Patent Law> and <the Trademark Law> will promote the legislative level of intellectual property protection. On the other hand, the level of intellectual property protection of the east region is higher than the middle and west regions. So promoting the middle and the east regions’ intellectual property protection is the necessary condition to make intellectual property protection regime more complete, and to further improve the scientific and technological level.On the part of empirical study, this study build s an economic index system on the influence of intellection property protection level. This study use s 31 provinces’ panel data in China from the year of 2001 to 2013. An empirical test is conducted between intellectual property level and economic influence factors in country, regions and provinces. The empirical study’s result indicates that among the east region, whose innovative level and innovative output is higher, the innovative factors can promote the intellectual property protection level. However, among the middle and west regions, whose economic development level is lower, the increase of average per capita income reveals a positive influence on the intellectual property protection level. This study provides an empirical support for studying intellectual property protection and economic influence factors on the basis of regions and provinces. Based on the above empirical study, this study concludes that according to different regions and provinces’ economic situation, different areas should enact different intellectual property protection policies which fit the locality’s development situation, and develop intellectual property protection regime’s key function in the innovative economic development.
