Chinese Patent System Arrangements Tackling Climate Change Problems

Global climate change is the serious challenge human beings are facing.It is undeniable that the fault zone of technological progress andenvironmental protection is widening. Although an instrument for stimulatinginnovation, the current patent system doesn’t handle climate crisis effectively.In order to give full scope to the ecological restoration function of patentsystem, it is time to adjust this system within measure, in accordance with theactual economical situation of different countries.Based on Marxist environmental theories, the study, with the methods ofdocumentary analysis, comparison analysis and logic analysis, tries to explorethe ecological restoration function of patent system and its deficiency,thenegative effect on environment of patent system are discussed as well. Andsystematically the study discusses the patent system tackling climate changesin our country. Finally, feasible measures are proposed.The study is of significant values in theory and practice. Theoretically,the relations of intellectual property rights and climate change are taken as thepoint of departure, and the climate-tackling patent theories are enriched tosome extent. Practically, the study has a try to make suggestions for the patentpolicy instruments, contributing to the protection of environment. This studyis necessary and of great significance in mitigating the climate crisis andstrengthening the adaptability to climate change.
