The Practice And Study Of Policies And Laws For Agricultural Machinery Purchase Subsidy

Subsidy policy for agricultural machinery purchase has been implemented for seven years. While making great achievements, the current subsidy model has also continuously exposed some problems. Management of agricultural machinery based on laws requires paying subsidy according to laws. Therefore, deeply studying on problems related to subsidy policy formulation and implementation strategies and legal issues involved is of very significant for its scientifically formulating and implementing.According to author’s own work practices and in-depth thinking, the interaction and interest conflicts among the main links (longitudinal), related the major departments, units and individuals (lateral) and related legal issues of subsidy policy formulation and implementation were systematically analyzed and investigated with system analysis method, in order to identify the source of the problem, to find relative policies and approaches and to improve subside practices in law and policies.In this paper, based on the summary and analysis of5main problems existing in current model of agricultural machinery purchase subsidy in China, which include lack of related laws and regulations, uncompleted policy system, insufficiently developed and constructed agricultural machinery management system, shortage of reliable financing channels suitable for agricultural machinery purchase in rural areas and effected fair competition, some suggestions for improving current agricultural machinery subside practices were proposed from the point of view of policy and practicesThe suggestions and strategies proposed in policy and laws and regulations are as follows.1Accelerate the legislations process of subsidy policy process.2Complete and improve subside policy system.3Strengthen construction and development of agricultural machinery organization system it self.4Develop preferential policies of financing for the machinery purchase.5Cancel subsidy catalogue and increase quality threshold.The proposed measures at operational level of include:1To ensure the safety of allowance funds, the method of paying funds should be "purchasing machinery with whole price, paying subsidy after purchased machinery being used, operation at different levels and paying subsidy separately in years2The detail operation measures that convert machinery purchase subsidy to machinery use subsidy were proposed.3It is pointed out that the necessity to make known to the public at village level, position and role of the village committee in subsidy operations, the reasonability of the provisions that subsidized machinery can not be transferred within next two years without permission need to be reinvestigated.In addition, according to author’s own practice and considerations the main legal issues involved in current subsidy measures were listed and some of them were answered according to his understanding.
