Urban house demolition and relocation is a hot issue particularly concernedby society at present. There are also some newwords comes like: nail household, forced demolition, and so on. The interestconflicts between different main parties are the focus of the problem. With therapid development of China Economy, the urbanization is also expedited.The paper take city T as an example, I interviewed many key person relatedfrom both demolition and removal side, find out that the interest conflictbetween main parties is primarily caused from several factors including theimperfection of current laws, inappropriate executive procedures, traditionalconcepts, and so on. Also I collected the papers and materials as well as readingrelated laws to find out that there are only two parties after the newhouse expropriation rules issued in2011. In some cities, some interest group inthe name of government departments drill loopholes in the law and abuse thepublic power of government, regardless of the immediate interests of the massesand the local actual condition. They blindly pursue the speed of economicdevelopment and urbanization, but neglect the implementation of compensationand relocation scheme, which lead to dissatisfaction of the masses and frequentviolent events. All of these factors have great impacts on the stability and theorder of the society.Therefore, effective coordination between different interests parties is an important topic for the legal and theoretical professions to explore and studycurrently. To effectively coordinate the relationship, we must analyze thehousing collection system in China, make clear of the manifestation of publicinterest vs. private interest conflict and also its deep sources, and then drawlessons from the experiences of other countries, identify effective solutions toeliminate the conflicts. For this purpose, we need to accelerate the legislationprocess set up reasonable executive procedure, complete judicial remedy, changeold concepts, and reasonably define government power, in order to coordinatethe relationship between public power and private rights, prevent abuse ofgovernment power, protect rights of citizens and further accelerate thecompletion of housing collection system in China.
