Migrant workers is a social special group in a special historical period of the process of industrialization and urbanization in China at present. The migrant workers with the double identify of farmers and workers, shifting from farms and factories constantly are making their livings by labour in employment in urbans.With the development of economy,the migrant workers in urban has become a social special group with a large number, an important power to promote the social and economic development and can not be ignored. However because of the impacts of the unfair systems of the household registration,employment, law and social security,which are all formed in dualistic systems for urban and rural areas respectively, the migrant workers are treated as edged identify of urban, excluded from the social security rights such as the labour protection, old age support, medical treatment education rights and social security rights, although the migrant workers has made great contributions to the social progress and economic development in urban. The problem of the migrant workers in urban seriously have seriously hindered fast and harmonious development of economy and society in our country. So establishing a scientific system for the migrant workers and giving them proper humanistic care and social acceptance are helpful to both economic efficiency and social justice to solve the problem of "agriculture, countryside and farmers",to promote the needs of sustainable development of the urbanization of rural areas and the coordination of urban and rural social, which are of great significance in the dealt.This paper mainly uses economics, sociology, law, political science and other related theoretical. Make further analysis about present situation and causes for the lack of the migrant workers rights by the method of standard analysis and empirical analysis.It draws a conclusion that it can't only depend on one single method to ensure the deserved rights of the migrant workers from infringement, in the contrary, a mutual and promotion and interconnected system should be established.In details, it should start from the innovation management system of household register, employment,social security system and education system for the migrant workers in the urban. The author put forward feasible policy suggestions about the protection of the migrant workers rights from the system perspective, so as to maintain the rights of the migrant workers legitimate.
