On The Problem Of Labour Security Supervisory And Its Countermeasure In China

Labour security supervision is the product of market economy. It is an important way for the State to adjust and interfere with the labour relationship subject to legal authorization. It is also an important element of the public supervisory service provided by the government. Time and social development have put forward pressing need on us to further the labour security supervision system of our country. One pressure is from the governing ideal of focusing on welfare, constructing harmonious society. It requires the labour security supervisory system to have more results in promoting the implementation of labour security supervisory system and the harmonization of labour relationship. The second pressure is from the implementation of "rule by law" policy and the improvement in the implementation of administrative laws. These have required a higher level of the normalization of labour security supervision. The third pressure is from globalization. This has demanded new input into promoting the integration of domestic labour standard and international labour standard.There are two problems to be solved in the analyzation and policy making by the researchers on the labour security supervisory system of China. One is lack of analysis from the aspect of public administration. The other is that the academic research does not go with the reality. As present theories and policy research cannot meet the need of the practice, an all-rounded systematic theoretical analysis and practical policy research from the aspect of public administration can fulfill and improve the Chinese labour security supervision theory, analyze the problems existed in this system practically and provide a reference for all levels of government agencies on demolishing the barrier in the labour security supervisory system and policies and founding a new system and new policy thinking.The main body of the article is divided into three parts. The first part of this article is mainly about an overview of the labor inspection system, including the labor inspection system, the historical development, definitions, characteristics, as well as the relationship between administrative supervision aspects. This part is mainly about the background and theoretical basis of labor inspection system. The second part is to write the problems of our existing system of labor inspection, including inadequate legislation, law enforcement non-standard, inadequate team-building aspects. The third part is to improve the specific proposals to the labor inspection system, including legislation, law enforcement, the increase in the number of teams, and the system of administrative responsibility.The paper bases the discussion on the theory of public administration, borrows experience from overseas and relates to the reality of China, uses methods of bibliographical research, comparative research, combines theoretical analysis and practical analysis to put forward useful policy on the improvement of the Chinese labour security supervisory system.
