The Impact Of The Special Safeguard Measures On China’ Export

By the fast development of globalization, special safeguard measures has been frequently used to hit the export of China as an unfair trade protecting measure under the frame of WTO, when the anti-dumping, anti-subsidy, and safeguard measures can not curb the high-speed growth of the export of China. Moreover, initiating special safeguard measures is more flexible and easier than initiating anti-dumping, anti-subsidy and safeguard measures in the implementing conditions and the procedures. From2002to2010, the WTO members had initiated the special safeguard measures of20(implemented of4) and the special safeguard measures on textile of21to China. In2009, US have implemented special safeguard measures on Chinese tires, the punitive customs duties up to35%has caused enormous negative influence to China’s export. Therefore, China should use legitimate weapon and take effective measures to counter with the special safeguard measures promptly, positively and initiatively.This paper mainly studies the impact on export and the counter-measures of China under the special safeguard measures.This paper mainly analyzes the case of US implementing TPS on Chinese tires. This paper divides into five parts.The first part is an introduction, mainly introduces and comments the predecessors’ research results of special safeguard measures.The second part outlines the special safeguard measures, mainly includes the meaning and the characteristics, the law theories, the differences to safeguard measures, and the economic effect of implementing special safeguard measures.The third part introduces the characteristics that foreign countries implement special safeguard measures to China, and analyze the economic and political reasons.The fourth part summarizes the impact on tires export to China under the special safeguard measures by statistically analyzing the Chinese tires export datas before and after2009that US implemented the safeguard measures on Chinese tires.The fifth part proposes countering-measure suggestions of special safeguard measures to China. China should value the research on the special safeguard measures, encourage the government, industry and enterprise to establish persistent response mechanism, and participate in the investigation and the consultation positively, and use the dispute settlement mechanism of WTO reasonably, solicit the folk support through lobbying and use the safeguard measures under the WTO frame reasonably to counter special safeguard measures positively, so as to promote the industry competitiveness and push the benign growth of the export of China orderly and stably.
