Legal Research On The Subject Of Emerging Shipbuilding Industry In The Marine Economy Era

As the State Council officially approved the" the plan on the development of marine economy in Zhejiang province demonstration area " and decided to set up a financial comprehensive reform region in Wenzhou city, which provides opportunities for the development of China’s emerging shipbuilding industry. At the same time, the new shipbuilding standard unveiled by the International Maritime Organization also has brought no small impact on our shipbuilding industry of which the technical aspects are relatively weak. The author does a deep research in Taizhou area which is the typical representative of the emerging shipbuilding industry, and has learned that the phenomenon of current ship anchored in Taizhou area is a very common, on the legal level, the thesis attempts to provide some comments and suggestions for the development of China’s shipbuilding industry, to provide legal guarantee for the development of China largest shipbuilding country towards the shipbuilding power.The thesis is composed of preface, main body and conclusion part. The preface mainly involves discussion of the social environment of China’s emerging shipbuilding under the current international and domestic background of developing marine economy.The main body does legal research on subject of emerging shipbuilding industry in the marine economy era through five parts.The first part of the body is "the present development situation of the emerging shipbuilding industry in the marine economic era ", in this part the author mainly elaborates the development history of the shipbuilding industry in our country, ushered in the development era of emerging shipbuilding in which the opportunities coexist with challenges, taking the Taizhou area which is of Zhejiang province as a model to explain the advantage and disadvantage of the development of emerging shipbuilding industry. The second part of the article is" the characteristics of the emerging shipbuilding industry subject under the marine economy era in Taizhou". in this part, the author aims at the problem of the subject features of shipbuilding, focusing on the theory and practice, to discuss the phenomenon of ship anchored which is often seen in our real life. The third part of the article is" the legal problems of the subject parties of emerging shipbuilding industry", this is the key part, in this part the author mainly discusses the rights and obligations of the two sides of the shipyard and the shipowner in the subject of shipbuilding, and combined with the typical case occurred in recent years to specific elaborated the legal status and responsibility to bear the relevant legal system. The fourth part of the article is" the new international situation that the emerging shipbuilding industry subject faced", In this part the author taking the ship emission reduction under low carbon economy as the starting point, lists a large number of standards of international and domestic shipbuilding industry and the attitudes of the international parties on developing the uniform standards of ship emission reduction, clearly puts forward the the future direction of our country guiding the shipbuilding subject to build the green ship. The fifth part of the article is" the countermeasures of shipbuilding industry subject under the marine economic era in China", in this section, the author combines the development situation China’s shipbuilding industry, From our government and shipbuilding subject this two angle, to put forward some suggestions on the construction of relevant legal system of China Shipbuilding Industry.The conclusion part emphasizes on conforming to the trend of the times to improve our legal system and strengthen the technological innovation to make China’s shipbuilding industry changing from large to power on the basis of development of shipbuilding industry throughout the domestic and international society.This thesis is innovative in three points:firstly, it’s innovative in focusing on research of affiliated shipbuilding, there is not much legal issues on China’s current research in shipbuilding process, when discuss affiliated shipbuilding, most domestic literature turn their attention to the operation of ship, secondly, it is innovative in discussion of typical cases in the new situation when China’s shipbuilding industry faces great opportunities and challenges, thirdly, on the background of marine economy development in China, the12th Five-Year shipbuilding industry plan puts forward that our country’s shipbuilding industry from large to power, low carbon wave calling green ship to construct the relevant legal system of China’s shipbuilding industry.
