China is currently in the city of rapid development of city, an obvious feature is the rapidexpansion of the scale of city, this expansion is the direct result of the large number ofagricultural land into urban planning, thus resulting in land use and development of thecontradictions and problems are more and more prominent, the main contradiction thelandless farmers resettlement compensation. After years of exploration and development, theformation of a variety of land compensation and resettlement mode, leave land resettlementmode as one of them, because it improves the actual compensation level, moderate landconflicts and other advantages, in theory and in practice have been affirmed, and gradually inthe nationwide promotion implementation. But stay in the resettlement policy, landacquisition by the village collective economic organizations should be how to operate andmanage the reserve land to make its protect value, appreciation to realize the benefitmaximization, how fair and reasonable allocation from the retention of land development andmanagement of access to the collective income and other issues, will be with the ground isarranged mode using rate increases and prominent, and evolved to effect the village collectiveeconomic organizations or even a region harmony and stability problems.This article take theShaanxi province Yulin City West Village as an example, to Pareto optimality criterion, usingBarlowe is a cost-benefit analysis framework, compares the different uses of reserve landdevelopment mode of investment efficiency, draw on the retention of land for businessdevelopment, the village collective economic organizations decision-makers the ability is avery important decision factor. When the village collective economic organizations decisionmakers operating capacity is weak, land acquisition by the village collective economicorganizations shall adopt and enterprise cooperation mode (including land pricing shares,commissioned by the business model and enterprise cooperation) minimum cost, but from thevillage collective economic organizations to obtain the final profit maximization perspective,using the property of repurchase model is the best choice; when the village collectiveeconomic organizations decision makers in business ability is strong enough, withindependent development mode can make the whole project cost is the smallest; on theretention of land for business development, due to the lack of funding, land acquisition by thevillage collective economic organizations is the best choice for cooperation with thegovernment model. At the same time, the author of the stay in the resettlement policy application and implementation of legal environment, retention of land property right,position and management issues are given the following recommendations:Stay in theresettlement mode as a relatively successful land compensation and resettlement mode, withits legislation, establish ground placement system, and the retention of land property right, theuse of direction and other relevant problem to make clear the unified regulations; theimplementation of the policy of area should be in economy relatively develop area, not farfrom the city to remote areas, with new and high technology industrial park or construction ofnew urban area using the policy best; to planning for the operation of land property rights inland expropriation should be retained when designated as state, at the same time to landacquisition by the village collective economic organizations for land leasing, the planning foroperation of land property right of retention shall be classified into collective ownership; thegovernment in the implementation of stay in the resettlement policy, deal with the land useplanning direction, to return to the land acquisition by the village collective economicorganizations of the plots of land; the government in implementing the policy process shouldpay attention to the planning and land was later guide, the village collective economicorganizations operating in the retention of land, should be considered their own situation,choose a suitable management mode, with independent development mode should be formed,both has the internal supervision mechanism, and the efficiency of the collective economicorganization form.Through to the West Village collective income distribution scheme ofanalysis, the author thinks that according to the average allocation scheme is unfair, but thescheme did not reflect on the long-term income security, lack of incentive mechanism. Theauthor uses the letters formula, gives a based on the principle of fairness allocation formula,and the collective way of income distribution problems, gives the following suggestions: thevillage collective economic organizations decision makers should take collective incomeallocation and operation of both ways: one is the operating reserve land income income aspart of development of retention of land capital, in the development, pay attention to get thelong-term benefits the development of the project; two is the year of extract a certainpercentage of income for the villagers to pay pension, work injury, medical and other socialinsurance costs; three is to establish the fund, or extract from the proceeds of a certainproportion by the special fund management company; four in the collective incomedistribution scheme, village cadre shall solicit opinions, the plan itself should follow bothfairness and the principle of incentive mechanism.
