Technological innovation has been an important driving force to promote economic growth of one country. And among factors which influence the development of technological innovation, intellectual property rights protection has played a key role. The original intention of the intellectual property rights is to protect and encourage technological innovation, but at the same time, it brings some negative impact. For example, it may lead to technology monopoly. So IPR protection is a double-edged sword. Therefore, the influence of intellectual property rights protection on technological innovation has received more and more attention. But due to the different viewpoints between the developed and developing countries, the problems in this field have always been the focus of debate in north and south countries. And scholars have not reached consensus on this topic.As a developing country, we also face the difficulty that how to choose the IPR policy. Based on this, the paper analyzed the influence of intellectual property rights protection on high technology industry’s innovation in China by using the theoretical analysis and the empirical test, and targeting on finding the effective ways to perfect the system of intellectual property rights and improve the ability of our county’s innovation. It has important theoretical value and practical significance.The main body and research results are as follows. The first part of the paper is introduction, which makes a brief introduction of the background, significance, framework, research methods, innovation and defects. The second part is the literature summarization. On the basis of reading extensive literatures, this part presents the study about the influence of intellectual property rights protection on technological innovation at home and abroad, and classifies them according to the theoretical and empirical research. Then by analyzing the achievement and insufficiency of current research, this paper puts forward my research idea. In the third part, the paper analyzes the action mechanism of intellectual property rights protection on technological innovation. This includes the direct action mechanism and indirect action mechanism through the technology spillovers of three channels of international technology transfer, which are FDI, international trade and technology introduction. The fourth part is empirical test. Firstly, the paper calculates the real level of IPR protection in China. Then it estimates the impacts of IPR protection, R&D expenditure, FDI, international trade and technology introduction on technological innovation using13sub-high technology industries panel data in China from1996to2011. Further more, introducing the interactive items of IPR and other factors into the econometric equation, this paper studies the synergistic effects of these items on technological innovation of high-tech-industry in China. The results suggest that R&D investment, human capital investment, FDI and export all have a positive effect on innovation. But technology introduction is non-significant. At the same time, the study shows that appropriate IPR protection has a positive effect on innovation, but if the level of IPR is too strong, it will reduce the benefit received from the technology spillovers of international technology transfer. So we should not only rely on improving the level of IPR to stimulate innovation. Finally, the paper summarizes the content and main viewpoints, and provides some reasonable policy suggestions.
