China has been a magnet for foreign job seekers thanks to its increasing overallnational strength, rising international status and flourishing regional economy. Moreand more foreigners have come to China, especially prosperous cities like Shanghai,for job opportunities. Such a massive wave of foreign labor force has not only addedfresh blood to China’s labor market, but also led to inevitable problems including:How to tackle the issue of illegal employment of foreigners in the context ofprosperous regional economy? How to ensure that foreigner employment is wellregulated with a scientific management mode? How to seek breakthroughs inemployment policies so that foreigner management policies are more consistent withChina’s reality? How to ensure that local labor market is stable while more foreignhuman capital is attracted to China amid the international competition for talents?Regarding these questions, this thesis presents an analytic study of both the currentsituation of and trend in illegal employment of foreigners in China in the context ofregional economic development. Based on comparison between foreigneremployment management in both China and other countries, this thesis analyzes theinadequacies of China’s current policies and regulations of foreigner employmentmanagement. Considering the new situations, this thesis also provides advice on howto improve employment management of foreigner in China.Research methodologies of this thesis include literature review, case study, andinterview with experts.The first part is to review and reorganize relevant basic theories. This thesis hasredefined foreigner management, and studied the history and development trend ofregional economy theory.The second part focuses on the current situation of illegal employment of foreignersin China and its impact. Based on analysis of the current situation, causes and impact of illegal employment of foreigners, this thesis attempts to find difficulties in lawenforcement regarding illegal entry, illegal residence and illegal employment offoreigners. This is crucial to the comparative study in the next part and even finalsuggestions of potential solution.The third part takes Shanghai as an example to study the development of regionaleconomy and its impact on employment of foreigners. This part introducesShanghai’s current policies for attracting foreign talents and the results, as well asfuture situations that foreigners may face when they work in Shanghai. The purposeof this part is to prove the inextricable connection between employment of foreignersand local economic development.The fourth part presents a comparative study of foreigner employment in China andother countries. Based on analysis of foreigner employment management in multiplecountries, this thesis points out inadequacies of China’s employment managementregulations. This part has used various methods for collecting information and cases,and conducts comparative study based on literature study and online informationsurvey. This part uses cases to compare policies and regulations, actual proceduresand law enforcement effectiveness regarding foreigner employment management inmultiple countries. This thesis then assesses current foreigner management in Chinabased on the above findings.The fifth part, based on the previous four parts, has proposed suggestions forimprovement of both internal regulations and external environment for employmentmanagement of foreigners in China based on excellent examples in other countries aswell as regional economic development and the status quo of foreigner employmentmanagement.Finally is the summary of this study and some points for further consideration. Thefinal part also proposes future improvement of this study.
