All along, lack of consciousness of engineering claims in our country and evenlack the strict sense of the concept of engineering claims.In particular, in projectcontracting relations, due to the contractor’s passive position, the contractor in order toobtain higher project benefits, in project management, with the expansion of foreigncontracted business, claims experience accumulating, gradually realize the importanceof claim management, and gradually improve the claim consciousness, and began toestablish special department, input dedicated resources such as manpower, materialresources to implementate the claims management work.Experts and scholars in ourcountry is also due to the contractor ‘s passive position, mostly to stand in the Angle ofthe contractor, for claims management theory and method of research, put forwardmany specific measures and methods to help them to put in a claim to the ownersmoothly. Therefore,for the owner side, project organization structure is not reasonable,lack of professional knowledge in project management, lack of claim consciousness andthe lack of engineering technology makes the owner in the claim management anddispute resolution in a completely passive position, which often makes the contractorclaim. Thus, increase the project cost greatly, and is very adverse to control the projectinvestment.Based on the trend of rapid development of the construction engineering project atpresent as well as the status quo of claims management, this article stands in the angle atthe project owners, propose owners claim management goals, and then from the aspectsof prevention, retort, active claim to analyze the way in detail how to achieve claimsmanagement goals. From the perspective of prevention, according to the theory offuzzy mathematics and the fuzziness characteristics of claim risk, construct thehierarchical fuzzy comprehensive and identification mode of claim risk, and secondorder claim risk model, for example, analysis the second order fuzzy evaluation mode ofthe underlying claim risk in detaile, and conclude the claim risk order, identify the mainrisk factors, provide basis for claim managers to grasp the main risk and implementateclaim risk management work. Focus on engineering change which cause theclaim,according to the theory of game theory, analysis the gambling behavior of theowners and contractors when engineering change, established the game model, bysolving the model, analysis their coping strategies, provides the basis for the owner to make decision rightly when engineering change and control engineering changerisks.From the angle of the counter claim, discussed emphatically the counter of claimreport.Finally through the analysis of the contract state, the analysis of the contractstate’s evolution and study the associations of contract variation and claim management,secondly through cost analysis, schedule analysis to recognize claim opportunity,provides a certain theoretical basis for the owners to implementate claim managementbetter and more effective, response to the claim more reasonable, and to reduceclaims disputes, control investment cost, obtain reasonable economic interests.
