Research On Legal System Guarantee For The Development Of Cultural Industry Under The Perspective Of Construction Of Cultural Power

In a certain sense, the cultural industry is a collection of cultural enterprise. Cultural enterprises is mainly about to providing cultural products including cultural products of state class, cultural products of labor form as well as cultural products that add value of products for other products or industries. Cultural products production has the characteristics of low consumption, low pollution and market mechanism. Its culture can be spread, industrial structure can be improved, thus to promote the construction of cultural power through developing cultural industry. In recent years, China’s culture industry develops rapidly. But during the rapid development of cultural industry, there still are several problems on cultural industry in China, including talent person, technology and market mechanism. Study on legal guarantees for the development of cultural industry is of great significance to promote the development of cultural industry.In this paper, besides introduction and conclusion, main body is divided into three parts:The first part is the study of the current situation of the development of cultural industry of our country. According to the current our culture industry development degree in China, this part summarizes the current status by dividing cultural industry into three parts, such as backbone, classification and other cultural industries. The main problems existing in the development of cultural industry in China, including strict market access, lack of fusion depth on science and technology, lack of talents and insufficient large-scale cultural group in the international competition.The second part is about the current situation of legal construction of the culture industry in China. This part reviews the history of the cultural industry in our country legal system construction. Our cultural industry construction in legal system has achievements in financing, taxation, foreign exchange and cooperation, construction market mechanism. And then, this part indicates some problems existing in legal construction of the culture industry, such as the deficiency of the legal system, the low standard of the legal rank and the conflict between laws and the market.The third part is the legal protection recommendations that promote the development of cultural industry. This part puts forwards the principles of economic and social benefits, the principles of management and the promotion and adhere to the legal principle of unity on the basis of the establishment of the legislation in " The legislative guidelines ". This paper gives advice to improve our country’s legal system of cultural industry from three aspects. They are formulate cultural industry promotion law, formulate special law of each industry and improve subject of market law. At the same time, the paper puts forward security recommendation according to the talented person, technology and some problems, which need to be resolved aimed at currently development of cultural industries.
